Cabinet Nods Lands Bills

  1. The Lands and Deeds Registry (Amendment) Bill, 2021.

Cabinet approved “The Lands and Deeds Registry (Amendment) Bill, 2021,” for publication and introduction in Parliament during the current sitting.  The objectives of this Bill are to amend the Lands and Deeds Act so as to provide for the electronic and digital signatures in land registration; the issuance and maintenance of a provisional certificate or certificate of title in electronic form.

Currently, the Lands and Deeds Act, Cap. 185 does not provide for issuance and maintenance of electronic provisional certificate or certificate of title and electronic and digital signatures in land registration.  It is envisaged that, with the new law, this will speed up the issuance of Title.

  1. The Lands Survey (Amendment) Bill, 2021.

Cabinet also approved “The Land Survey (Amendment) Bill, 2021,” for publication and introduction in Parliament during the current sitting.  The main objectives of this Bill are to provide for the issuance and maintenance of a diagram, general plan and any other survey records in electronic form and facilitating electronic transactions, including the use of an electronic and digital signature by the Surveyor-General.  Currently, the Land Survey Act, Cap. 188 does not provide for electronic registration and this poses challenges in carrying out survey works due to advancement in technology.
